Customer Agreement
Privacy
We will never share or sell your personal information, such as name, telephone number, or e-mail address. Your DVD slideshow presentation will also never be viewed by anyone other than the owner of Captured Moments DVD. We may make occasional requests to use excerpts of your slideshow for sample viewing purposes on our website, but will never do so without your written consent. We value our customers privacy, and agree to never do anything to compromise your personal information or your submitted materials.
Limits of Liability
Captured Moments DVD is not responsible for lost, late, damaged, or misdirected mail, and Captured Moments DVD takes no legal responsibility for any losses or damages of any kind. Customer is aware that all DVDs are produced in DVD-R format, and no refunds will be issued due to personal DVD player incompatibility. By submitting an order, Customer declares and warrants that all photo materials provided for slideshow production are not in violation of any copyright laws. Customer will indemnify and hold Captured Moments DVD, and it's owner, harmless in respect to any claims or demands by any third party that infringes upon any copyright law. The materials submitted were either created by Customer or Customer has the right to permit Captured Moments DVD to perform duplication services, or Customer has the permission of the copyright owner to duplicate photo materials and written release form is provided.
If you choose to use copyrighted music material in your purchased DVD, you must obide by the Fair Use Provision of the music copyright laws. Captured Moments DVD agrees to legally purchase music files on your behalf from reputable online retailers for one time use in your slideshow. By purchasing a DVD from Captured Moments DVD, you, the customer, agree to use the slideshow for personal use ONLY and not for fee-based public exhibition or for resale.
The Fair Use Provision of the music copyright laws contains the following criteria:
- The user owns a lawfully-acquired or purchased copy of the original work.
- Few copies are made.
- There is no significant effect on the market, or potential market, for the copyrighted work.
- No similar product (i.e. DVD slideshow) is marketed by the copyright holder.
- Once the music is included in your DVD, the song file is deleted to prevent further use.
Acknowledgement
Having read and understood this agreement, you acknowledge its priority to any order, engagement or advertisement, and agree to its terms. By placing an order with Captured Moments DVD, and receiving these terms and conditions, you are acknowledging that this is a binding legal agreement between Captured Moments DVD, and users of DVD slideshow authoring services provided by Captured Moments DVD. DVD presentations are provided by CapturedMomentsDVD via http://capturedmomentsdvd.com, with no warranty of any kind.
